Tophole, is the only establishment that offer creative works that allows one to relinquish all rights to a customer/business client (only independent project request from songwriters and poetry writers, offers sales with relinquished rights certificate or sales with no relinquished rights certificate).

Tophole members that register to market their skills/looks/voice, are considered independent contractors and stated persons work for themselves and or these such person work with that person or organization, that their contracts does not restrict them from doing business at tophole.

Tophole is not your management company or your representative, tophole connects you to others to do business with and build your world and life.

Tophole does not issue you any tax documents.

You, the customer/member, can keep tabs of how much you make as you do business at tophole.

To do business at tophole, you know how to run your business, market yourself and sell yourself and or talent and or you have an adult representative that helps you to do business at tophole and that adult representative, knows how to market you or your skills and knows how to run a business.

Tophole has marketing base (s), that are free or a fee is required to be paid each month and or per year.

Tophole along with the membership fee, offers either monthly membership fee, without seller fees and or membership fee with seller’s fee.

Tophole offer’s a lifetime discount and stated discount, is available to customers that register and sign up to become tophole member/seller at those opportuned times its offered to the public (tophole lifetime discount, is available during prelaunch sale).

TOPHOLE’S AGE POLICY

With the fact of tophole markets person (s) and skill (s), any age can become a member. However, up until age 17, a member requires an adult representative to cater to their business needs as stated member is being marketed at tophole for business/work. Once a member is 18 years old, a member, can market themselves at tophole without an adult representative

TOPHOLE’S COPYRIGHT POLICY

Tophole requires member (s) sales listing be copyrighted before stated product/merchandise, is uploaded unto tophole’s marketing and selling ecommerce portal. As such, jingle and beats makers, songwriters, poetry writers and script writers, must copyright their creative work/product for sale and stated creative work, when sold, the buyer owns it. Book author, poster artist, inspirational gift and products, greeting cards, graffiti artist and psychedelic artist, requires their creative works to be copyrighted but with this understanding that all should be aware of, the books for sale, the posters for sale, the inspirational gift and products for sale, the graffiti creative works for sale and the psychedelic creative work for sale, although copyright protected, copyright license to offer stated product to the public for sale, also exist with stated copyright protected creative work. Members of tophole E and F, must also copyright their creative work being offered for sale. Here also, with stated creative work copyright protected, copyright license to offer stated product/merchandise to the public, also exist with stated copyright protected creative work.

In a country where copyright capabilities does not exist, your work uploaded for sale at tophole, protects you. For independent projects and those outside of the USA and within the USA, you do have the option to upload your creative work to have it be protected at tophole as its being sold and or as it is sold to a registered business client.

As a member/seller’s, creative work are copyright protected, if one of tophole’s member and or seller, steals a members/sellers creative idea or work and or if one of tophole’s member and or seller, uses one of a members/sellers creative work without their permission, stated member reported, will be banned from continuing to do business at tophole. Stated member’s online store, will also be removed and deleted from tophole marketing and selling ecommerce portal. Stated member, if a membership fee is paid for the month and or year, stated member’s fee, will not be reimbursed and or refunded. Tophole shall not be sued for stated fee for any reason due to tophole’s lawsuit waiver policy agreed upon as one of a term and condition to utilize tophole marketing and selling ecommerce portal to do business from.

TOPHOLE SELLERS/MEMBERS AND BUSINESS INSURANCE/SHIPPING INSURANCE

Tophole requires all its sellers to carry shipping insurance for each sale made. As such, its either a seller has shipping insurance for their business or selling needs or a person that sells at tophole, must include shipping insurance for sale made.

As it is highly recommended and advisable that sellers (high volume sellers, sellers with store fronts, sellers with home stores, business clients with offices, etc)  have business insurance while doing business at tophole, tophole does not require the business insurance verification processing or undergo the business insurance verification processing from sellers to sell at tophole. Neither does tophole keep track of your business insurance status. To sellers/members this applies to, for the kind of insurance you should have as you run your business here at tophole, please consult with your business insurance agency for further assistance. 

TOPHOLE’S LAWSUIT WAIVER POLICY AND EXCEPTION TO TOPHOLE’S LAWSUIT WAIVER POLICY

To shop or do business at tophole A, B, C, D, E, F, G, H, I, J, and to utilize tophole advertising, our policy requires all customers/sellers/members, to waive their right to sue.

With the fact of tophole’s lawsuit waiver policy in effect and as tophole does not require the business insurance verirfication processing or undergo the business insurance verification processing from sellers to sell at tophole, if an occurrence takes place that requires you to sue, tophole does not and will not participate in any litigation that arises from such lawsuit filed, as such, tophole should not be noted as a defendant. Neither will tophole participate in stated discovery happening with stated lawsuit. Nor will tophole and any of its representative, appear as a witness at stated lawsuit filing (exception: If and when one of tophole’s member sues another member or a public person/organization for stealing their idea or when a member sues another member or a public person/organization for not seeking their permission before using their creative idea), tophole will assist such member by providing proof of the creative work idea stolen and or providing proof of the creative work used without the owner’s permission requested.

As such, with the fact of tophole’s lawsuit waiver policy in effect, tophole is not aware if a member/seller has business insurance. Neither does tophole make an inquiry as to if our sellers/members, have business insurance.

As tophole is an e-commerce platform that allows members/sellers to market and sell their product/merchandise at tophole, as you do business at tophole, outside of tophole or as you shop at tophole and as you utilize tophole’s services, tophole requires members/sellers/customers, to waive their right to sue. Neither will any partake in any kind of arbitration that occurs from any occurrence that stems up as you do business from or at tophole, outside of tophole or with the fact of you shopped at tophole, was gifted from tophole or shop at tophole. As such, if you or any cannot adhere to tophole’s lawsuit waiver policy, do not do business or be a member/customer/seller at tophole. As such, being a member/seller at tophole, all are harmless to tophole.org, tophole, LLC and its affiliates and representatives.

CANCELLATION POLICY

As a member at tophole, as per agreement agreed upon during the registration processing, you, the customer and or prospective customer, are committed to the term of service paid for (annual and or monthly). When the terms as paid for is met (annual and or monthly), you can decide not to continue on with tophole scouting marketing and selling service.

AGREEMENTS TO ABIDE BY

You agree to be displayed here for your business needs fulfilment

You agree that as you are displayed here for your business needs fulfilment (s), once you sign up and make either an annual and or monthly payment, you are committed to that year and or monthly service and can cancel after such term if you please.

You agree that businesses and other members that are registered with tophole, can or may contact you for their business need fulfilment.

You do agree and realize this is a marketing service and tool that allows you, the talent (s), to be able to connect, expose and sell their talents/creative works, in a centralized stance of handlings, as such, this is not an employment agency. Neither is this a talent agency and as its totally based on one’s efforts, talents and skills, we are not here to guarantee you employment as we pave the way to market talents and creative skills/works as you work to build your world and life and or a represented life and world (registrant/adult representative).

You do agree to not communicate via any other source during when a business initiation approaches you and or you them and as this applies to the fact of communication that can happen with all businesses and or other members, as such and to initiate business as a registered member,

you do agree to communicate via the messaging and or communication system (s) available, that’s lets you do that.

You have reviewed and agree to abide by tophole’s terms and conditions, privacy policy, security policy, legal policy and all tophole’s handling standards.

PHOTO UPLOAD AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you are bound by the agreement below:

You agree to have your photo (s) uploaded to tophole scouting marketing and selling service and attest to the fact that the photo (s) uploaded, is/are not professionally produced by a photographer.

and or;

A member can upload professional pictures of themselves. To upload a professional picture of yourself (s), a member must own the rights (copyright) of the picture taken as uploaded.

The professional picture (s) uploaded that is copyrighted, you agree to have your photo (s) uploaded and attest to the fact of you own the right (s)/copyright (s) to stated picture, as such, the original document (s), that proves you own the rights to stated picture (s), is/are in your possession signed by the photographer (s).

VIDEO UPLOADING AGREEMENT

For Model marketing and selling service ONLY

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

You agree that stated video being uploaded shows you modeling.

You agree that stated video, can be posted to your marketing and selling page at tophole and or if need be, you attest to the fact of you obtained written permission to upload and post stated video showing you modeling, to your marketing and selling page.**

**Written permission requirements is the member has the original document in their possession as signed by the person granting permission to upload stated video of a member modeling unto a members marketing and selling page**

VIDEO SALES PRESENTATION AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

The seller can record the sales presentation at their store location

The seller can record the sales presentation at their home location

The seller can record the sales presentation at a video production business location

The set where the recording takes place must be well-lit and well-laid out.

The video being uploaded is 30 mins or less

BUSINESS CLIENT PRE-ACCESS AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

You are made aware via tophole online scouting marketing services that each sellers work are copyrighted. If you do not buy a seller’s work as accessed (heard or seen), you can be sued, if you plagarize and steal a seller’s creative work.

VIDEO PRODUCTION/AUDIO PRODUCTION MARKETING AND SELLING AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

You attest to the fact of the creative works uploaded unto your marketing and selling service page, was originally written and created by you and or you attest to the fact of stated creative works as created for one of your clients, you have your clients written permission to upload stated creative works project done by you unto your marketing and selling page.

COMMERCIAL/STUDIO PHOTOGRAPHY MARKETING AND SELLING AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

You attest to the fact of the creative works uploaded unto your marketing and selling service page, is a photo taken and developed by you.

You attest to the fact of stated photo as taken and developed by you for one of your clients, you have your client’s written permission to upload stated photo project unto your marketing and selling page.

CREATIVE WORK SALES LISTING UPLOADING AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

Jingle maker, beat maker, songwriter, poetry writer, book author, greeting card maker, poster maker, inspiration gift/product owner, fine art maker, graffiti maker & psychedelic art maker.

You protected your creative work by having stated work undergo the copyright and or copyright licensing processing.

You agree that your creative work, can be displayed for sale (heard or seen), for marketing/selling purposes and or for any business opportunity which may come your way.

RADIO DISC JOCKEY/MIXER ONLINE SCOUTING, MARKETING AND SELLING SERVICE UPLOADING AGREEMENT

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

You attest and agree to the fact of all and any uploaded and updated creative works of performance, was originally created by you and is your original work as utilized at tophole for your creative works scouting, marketing and selling needs.

You attest and agree to the fact of stated creative works uploaded and or updated, has no artist music present or royalty free music is present.

RADIO PERSONALITY ONLINE SCOUTING, MARKETING AND SELLING SERVICE UPLOADING AGREEMENT

As needed, all members/sellers, must write and produce their creative work content. For your creative work uploading requirements, all members, follow the format laid out by tophole. As such, radio personnel’s that uploads a show, are allowed to use real stories or make up stories for their recording. All recordings, no music is present and or royalty/copyright free purchased music, is present.

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

As per tophole’s policy and handling standards, you attest to the fact that the creative works content (news, weather and event story) being uploaded, is originally written and produced by you for your tophole scouting marketing and selling page.

You attest and agree to the fact of stated creative works uploaded and or updated, has no artist music present or royalty free music is present.

ANNOUNCER/VOICEOVER ONLINE SCOUTING, MARKETING AND SELLING SERVICE UPLOADING AGREEMENT

As needed, all members/sellers, must write and produce their creative work content. For your creative work uploading requirements, all members, follow the format laid out by tophole. As such, announcers that uploads an announcing sample/gig or voiceover sample/gig, are allowed to use real products, services, etc or make up stories for their recording. All recordings, no music is present and or royalty/copyright free purchased music, is present.

To utilize tophole’s scouting, marketing and selling base, you agree and are bound by the agreement below:

As per tophole policy and handling standards, you attest to the fact that the creative works content being uploaded, is originally written and produced by you  for your tophole scouting marketing and selling page and or,

Stated professional work (s) uploaded, you have written permission, allowing stated creative work (s), to be uploaded unto your marketing and selling page/store.

You attest and agree to the fact of stated creative works uploaded and or updated, has no artist music present or royalty free music is present.

TV NEWSCASTER SCOUTING, MARKETING AND SELLING SERVICE UPLOADING AGREEMENT

The creative works uploaded, you attest to the fact of you did partake in the stance of creating stated creative works, as such, you have permission to upload stated creative work unto your marketing, selling & scouting page or you attest to the fact of you own the copyright (rights) to the creative works uploaded and do agree to have stated creative works be uploaded unto your marketing, selling and scouting page.

In each stance, the prospective TV merchandise seller/presenter talent, must introduce the company that them are selling an item from (utilize TOPHOLE TV shopping channel as name of company to use during recording of selling presentation).

In each stance, the prospective TV merchandise seller/presenter talent, must introduce and sell the product selected.

In each stance, the prospective TV merchandise seller/presenter talent, must sign off (make sure to use your real self-information and use “TOPHOLE TV” shopping channel as the company name to utilize during recording of sales presentation being recorded).

The music name is “tophole” and or the phrase “a music by tophole,” should be used to introduce the music before “going on break” announcement. When royalty free music is utilized, the name of the music  and artist, can be utilized.

A stance of the radio personality talent, after coming from break, is doing a presentation introducing a music (music title that music be utilized is “tophole” and or the phrase “a music by tophole.” Using “tophole” and or the phrase, a “music by tophole,” music will not be present in your recording).When royalty free  music is introduced after break, the music can be played and the name of the artist can be utilized.

A stance of the radio personality closing out a music that just played and talent going into a presentation about the weather (weather news). The music title that must be utilized to close out a music that just played is “tophole” and or the phrase “a music by tophole.” When a royalty free music is utilized and played, the name of the music and the artist, should be announced. The talent, should create, write and read the weather forcast news as originally written and produced by them.

A stance of the radio personality talent doing a news coverage presentation happens right after the weather (do news coverage as originally written and produced by you)

In each stance and after coming from a commercial break, a member must make an announcement coming from a commercial break and that announcement, takes them into the news segment happening right afterwards. The TV news casting talent, must then do a news segment again.

In each stance, the TV news casting talent, must sign off (make sure to use your real self-information and use TOPHOLE TV as the TV call letter for your recording needs)

Each personalized creative work recorded (all stance above must appear as one in every creative works uploaded and yes, get creative with it). The member must upload those creative works separately as prompted and each recording allows 30 minutes of recording time to be saved to each creative works uploaded to your scouting marketing seller page

With the stance of 8 pictures required to be uploaded, when it comes to the face shot picture fulfilment needs, a “smiling” and a “not smiling” picture is required. Also and when it comes to a members face shot fulfillment needs, a left and right profile of your face is required. To fulfil your full body shot picture needs, a left and right profile of your body is required. Also and when it comes to a members full body shot picture needs, a full length front body shot and a full length back body shot is required.

To utilize such photo at their scouting selling and marketing base, it’s required the member owns the rights to the picture and not the photographer, as such, the member must create a document/agreement, that states the fact of stated photo is owned and will be copyright protected by them and stated agreement must be signed by both parties.

FOR OTHER KINDS OF TALENTS AS PRE-PROGRAMMED AT YOUR ACCOUNT;

Make sure the background of your picture is white, grey, black and or any color and or make sure the background picture used is commercially licensed, as such, any can use such commercially licensed background picture.

Here too, each talent within a group, does not require a professional picture to be uploaded unto tophole’s scouting, marketing and selling store. Here too, a member can upload professional pictures taken by a professional photographer. To utilize such photo at their scouting selling and marketing base, it’s required the member owns the rights to the picture and not the photographer, as such, the member must create a document/agreement, that states the fact of stated photo is owned and will be copyright protected by them and stated agreement must be signed by both parties

For the talents that are a group, as its required to also upload 4 pictures of all members of stated group in a picture, here too, a professional taken picture, is not required to upload your photo’s unto your marketing and selling page. Here too, a group picture members, can upload professional pictures taken by a professional photographer. To utilize such photo at their scouting selling and marketing base, it’s required the group picture members, owns the rights to the picture and not the photographer, as such, the group talents, must create a document/agreement, that states the fact of stated photo is owned and will be copyright protected by stated group and stated agreement must be signed by all parties in the group including the photographer.

TOPHOLE SECTION A  AND B VIDEO SALES PRESENTATION UPLOADING HANDLING POLICY

Tophole section A and B, where sales presentations are made available via video, has video uploading standards that must be adhered to.

The seller can record the sales presentation at their store location

The seller can record the sales presentation at their home location

The seller can record the sales presentation at a video production business location

The set where the recording takes place must be well-lit and laid out.

The video upload feature allows up 30 mins of recording time.

TOPHOLE’S RELINQUISHED RIGHTS CERTIFICATE HANDLINGS STANDARD AGREEMENT/POLICY

To do business at tophole, the standardized business model, is all rights to a creative work, must be relinquished once sold to a buyer. As such, relinquished rights certificate forms, are available at each member/sellers online store to utilize during a sales transaction. Only Songwriters and Poetry/poem writers, have the option to not relinquish their rights to a creative work during a independent project sales transaction. As such, to do business at tophole, you agree and are bound to the below handling standards;

​

Commercial/studio photography talent members are required to issue out relinquished rights certificate to all photo shoots and session bookings as paid for. It’s required that a commercial/studio photography seller/member upload the relinquished rights certificate issued to a sale unto their account. If a commercial/studio photography seller/member, does not upload the issued relinquished rights certificate, the seller/member, will not be able to process any sales until the required documents are uploaded unto their account.

Video/audio production talent-as member are required to issue out relinquished rights certificate for all creative works projects booked as paid for. With the fact of the relinquished rights certificate signed, it’s required that a video/audio member/seller, upload a copy of the relinquished rights certificate as issued to a sale unto their account. If a video/audio member/seller, does not upload a copy of an issued relinquished rights certificate, the seller/member, will not be able to process any sales until the required documents are uploaded unto their account.

TV/Film crew talent members are required to issue out relinquished rights certificate for all creative works, production works, design and or writings as per bookings from a customers as paid for. With the fact of relinquished rights certificate signed, it’s required that TV/Film seller/member, upload the relinquished rights certificate as issued to a sale unto their account. If a TV/Film seller/member, does not upload the issued relinquished rights certificate, the seller/ member, will not be able to process any sales until the required documents are uploaded unto their account.

Songwriters and poetry/poem owners/sellers have 2 options;

​

Relinquished rights certificate is required to be issued to a sale, as such, the only stance and exception of when a member/seller has 2 options is when a customer (business client), request an independent project, as such, based on the agreement between the seller and stated business client (customer), the member/seller, can issue out relinquished rights certificate and or the sales may be handled without issuing out a relinquished rights certificate (the sales agreement exist amongst the seller and the business client and tophole does not play a part in that stance of transactions happening). However, tophole does maintain record keeping track of such activity taking place. Also, tophole does allow the seller to collect payments from tophole payment services.

Book/authors, greeting card owners/sellers, poster owners/seller, graffiti artist owner/seller, psychedelic artist owner/sellers, scriptwriters, inspirational products/gift owners/sellers and fine art owners/sellers

TOPHOLE “PICK UP IN PERSON” POLICY

​

Tophole section A sellers (greeting card, poster sellers, book sellers, inspirational gift and product sellers, graffiti sellers, fine arts and psychedelic sellers), that own a storefront, are allowed to offer “pick up in person.” If a seller does not own a storefront, pick up in person, is not made available to such seller to the consumers.

Tophole section B sellers, that own a storefront, are allowed to offer “pick up in person.” If a seller does not own a store front, pick up in person, is not made available to such seller to the consumers.

Tophole section C sellers, E sellers, F sellers, and J sellers, pick up in person, is not made available to such sellers to the consumers. All items purchased, can be mailed to the purchaser or the creative work if possible, can be uploaded and sent to such customer via their tophole email address.

TOPHOLE “IN PERSON DELIVERY” POLICY

Tophole section A-In person delivery are made available to Songwriters, poetry writer, script writer, jingle and beats maker only. These sellers, are also allowed to charge delivery fees.

Tophole section B-In person delivery are made available to sellers with a storefront to tophole’s registered customers/consumers. These sellers, are allowed to charge delivery fees

TOPHOLE’S RETURN & EXCHANGE HANDLING STANDARD

TOPHOLE SECTION A

​

Scriptwriters, jingle makers, beats makers, song writers and poetry writers, as per tophole handling standards, do not accept returns and or exchanges. However, a seller that sends a defective CD and recording, must issue out a new recording of purchased item to a buyer. Also, when it comes to scriptwriters, jingle makers, beat makers, song writers, poetry writers and their customers, a business client, has 24 hours from when a product is purchased, to cancel a sale (a business client, can cancel the sale themselves via their account). After 24 hours, a business client, cannot cancel a sale by themselves, as such, a business client, must make a request to the seller to cancel the sale.

Other sellers that are not scriptwriters, jingle makers, beat makers, song writers and poetry workers, do have a return and exchange policies and some may not offer return policy (s) or exchange policy (s). Again, here  too, as per tophole’s policy, a defective item upon arrival and or an item that is not as described, a seller, is required to work that out via a customer by offering an exchange and or a refund to such customer. As per the exchange and refund option available, the customer makes a selection as to the next step that will happen.

For those Tophole Section A sellers that are able to list their sale at Tophole section B with a fee paid, those such sellers, that do not offer return policy (s) or exchange policy (s), are able to offer Tophole’s merchandise credit, to their customers return or exchange request.

If your membership fee is paid for the month and you get banned from doing business at tophole, no refunds will be issued to you.

Tophole’s terms and conditions, security policy, privacy policy, legal notice, advertising policy and all handling standards set forth at tophole’s various marketing and selling base, can be updated without notice to its members.
